you must not use the platform. SafeToMediate™ is a professional decision-support system intended for qualified users only.

 

2. Nature of the Platform

SafeToMediate™ is a structured pre-mediation safety and risk assessment tool designed to
support professional judgment in civil, family, court-connected, and institutional dispute
resolution settings.

It is:

  • A decision-support tool only
  • Not a diagnostic system
  • Not a substitute for legal, clinical, or judicial judgment
  • Not an emergency or crisis response service


Users remain solely responsible for all professional decisions made using the platform.

 

3. Eligibility and Authorized Users

SafeToMediate™ is intended for use by qualified professionals, including:

  • Mediators
  • Attorneys
  • Mental health professionals
  • Court intake personnel
  • Institutional and organizational conflict resolution staff
  • Other authorized professional users or entities

We reserve the right to restrict or revoke access at any time.

 

4. User Responsibilities

Users agree to:

  • Use the platform only within their professional scope
  • Enter accurate and lawful information
  • Maintain confidentiality of any case-related data
  • Not use the platform for unauthorized diagnostic, legal, or clinical determinations
  • Comply with all applicable laws, ethical standards, and institutional policies

 

5. Data Use and Confidentiality

All information entered into SafeToMediate™ is handled in accordance with the Privacy Policy.

We:

  • Do not sell user or assessment data
  • Use data solely for platform functionality, security, and authorized institutional use
  • Restrict access through role-based permissions

Users acknowledge that data handling is subject to technical and operational limitations.

6. Professional Judgment Disclaimer

SafeToMediate™ provides structured indicators to assist decision-making but does not replace
professional judgment.

All final determinations regarding:

  • safety
  • mediation appropriateness
  • legal action
  • clinical interpretation
  • case management

remain solely with the user or their supervising institution.

7. No Emergency Services

SafeToMediate™ does not provide emergency, crisis, or law enforcement services. If a situation involves immediate risk of harm, users must contact appropriate emergency
services directly.

8. Intellectual Property

All content, tools, frameworks, assessments, and materials within SafeToMediate™ are the
intellectual property of SafeToMediate™ unless otherwise stated.

9. Access Control and Security

We may:

  • Limit access to authorized users
  • Suspend or terminate accounts for misuse

10. Limitation of Liability

  • We are not liable for decisions made based on platform outputs
  • We are not responsible for case outcomes, legal decisions, or clinical actions
  • We disclaim liability for indirect, incidental, or consequential damages

11. Indemnification

Users agree to indemnify and hold harmless SafeToMediate™ and its developers from any
claims arising from misuse of the platform or violation of these Terms.

12. Modifications

We may update these Terms at any time. Continued use constitutes acceptance of changes.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law
principles.
